GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale define the rules for providing the company’s vehicles to clients as part of the Agafay Cayenne Experience service.

The client may either be a passenger or a driver, if meeting the required conditions, drive under the direct supervision of the instructor pilot, for a duration determined by the selected package.

1. Nature of the Service
  • ​This is a supervised driving experience, not an autonomous vehicle rental.
  • Driving is only permitted for adult clients holding a valid driver’s license, and only in the presence of the pilot inside the vehicle.
  • ​The instructor pilot may take control at any time if safety requires it.

2. Conditions of Participation

  • Minimum age required: 12 years (as a passenger)

  • For clients wishing to drive: minimum age 21, with a valid driver’s license held for at least 2 years

  • Minors must be accompanied by a responsible adult

  • ID is mandatory for all participants

  • Mandatory signing of a rental agreement and a liability waiver before departure

  • Participants must be in good health and not under the influence of any psychotropic substance (medications, drugs, alcohol, etc.)

If, at the time of departure, the instructor pilot deems that the required conditions are not met, they may unilaterally cancel the service. Such a cancellation due to disqualification will not entitle the client to any refund or compensation.

 

3. Supervision and Safety

  • The route is predefined and may be adjusted based on terrain or weather conditions

  • Seatbelts must be worn by all vehicle occupants

  • Participants agree to strictly follow the instructor pilot’s instructions

  • The use of illegal drugs or alcohol is strictly prohibited throughout the experience and on company premises

  • Any dangerous behavior will lead to immediate termination of the activity

The company reserves the right to cancel participation of any driver or passenger if their conduct jeopardizes the experience or infringes on the rights or wellbeing of others.

If the instructor pilot ends the activity due to participants not following instructions or for inappropriate behavior, no refund or compensation will be provided

 

4. Insurance and Liability

  • The vehicle is covered by third-party liability insurance

  • The client participates fully aware of the risks associated with off-road driving

  • The organizer declines all responsibility for personal belongings (loss, theft, damage)

  • Participants waive any liability claims in case of incident resulting from failure to follow instructions

5. Security Deposit

  • No security deposit is required

  • However, in the case of willful damage or serious breach of contract, the client may be held financially responsible

6. Delays and Cancellations

  • Any delay of more than 15 minutes may result in the cancellation of the service without refund

  • Client cancellation less than 72 hours in advance: no refund or rescheduling possible

  • Client cancellation more than 72 hours in advance: rescheduling possible

  • Client cancellation more than 1 week in advance: rescheduling or free cancellation possible

  • Cancellation by the organizer (breakdown, weather, force majeure): full refund or rescheduling

7. Refunds and Credits
The full amount is required in advance and covers the entirety of the reserved service.
No refund will be granted if the client shortens the duration of the service.

 

8. Payments
Payment is made upon reservation (online by credit card, by bank transfer, or in cash), or at the latest on-site before departure.

 

9. Weather and Route Changes
In case of adverse weather conditions, the organizer reserves the right to modify or postpone the experience.
No refund will be granted for route changes made for safety reasons.

 

10. Image Rights
The organizer reserves the right to take photos and videos during the activity for promotional purposes.
Clients may refuse image rights in writing prior to departure.

 

11. Mechanical Issues – Delays
The organizer disclaims all responsibility for delays caused by breakdowns or necessary repairs to the vehicles.

 

12. Driver’s License
Drivers must hold a valid and unrestricted license in their country of residence.
The driver assumes full responsibility for complying with the regulations in force in Morocco.
The driver must follow the instructor pilot’s guidance to adapt their driving to Moroccan road conditions.

 

13. Registration
Once the reservation is confirmed with the provider, the client may proceed with the registration process, which is necessary for the team to validate the booking.
The client will receive a personalized link to securely complete their registration.
The following documents must be uploaded and submitted:

  • Copy of passport

  • Copy of driver’s license

  • Signed and completed liability waiver

14. Applicable Law and Jurisdiction
This contract is governed by Moroccan law. In case of a dispute, only the courts of Marrakech will have jurisdiction.
