
These General Terms and Conditions of Sale define the rules for making the company’s vehicles available to customers as part of the Agafay Cayenne Experience service.
The customer can be a passenger or, if he meets the required conditions, take the wheel under the direct supervision of the instructor driver, for a period of between 1 hour or 8 hours depending on the formula chosen.
This is a supervised driving experience, not a self-contained vehicle rental. Driving is only allowed to adult customers with a valid driving license, in the mandatory presence of the driver in the vehicle. The training pilot can take control at any time if safety requires it.
2. Conditions of Participation
The participant must be at least 10 years old if they are a passenger, or 21 years old and have held a valid driver’s license for at least 2 years if they are driving, without a recent serious offence.
Driving under the influence of alcohol, drugs, illicit substances or medications that impair abilities is strictly prohibited. Any violation will result in the immediate interruption of the service without refund.
Minors must be accompanied by a responsible adult. Proof of identity is required. The signature of the booking voucher and the acceptance of these T&Cs are required before departure.
3. Supervision and Safety
The route is fixed in advance and may be modified for safety or weather reasons. Wearing a seat belt is mandatory. The instructions of the instructor pilot must be strictly respected. Any dangerous behaviour leads to the immediate cessation of the activity, without refund or compensation.
4. Insurance and Liability
The vehicle is insured for civil liability. The customer acknowledges the risks involved in off-road driving and participates in its risks. The organizer is not responsible for loss or damage to personal belongings. Any liability claim relating to non-compliance with the instructions is excluded.
5. Security Deposit
No deposit is required. In the event of damage to the vehicle, the customer will be held responsible for all repairs. A flat-rate deductible of 50,000 DHS will be automatically invoiced on a provisional basis, pending the exhaustive quantification of the damage. The service provider also reserves the right to pre-authorise the driver’s credit card before departure, in an amount equivalent to the excess.
6. Delays and Cancellations
A delay of more than 30 minutes after the agreed meeting time will result in automatic cancellation without refund (no show).
Customer cancellation (amounts retained correspond to service fees) :
• More than 4 weeks before the scheduled date : 90% refund or postponement possible.
• Between 4 weeks and 72 hours before the scheduled date : 50% refund or postponement possible.
• Less than 72 hours before the scheduled date : no refund possible.
Cancellation by the organizer: postponement or full refund.
7. Payment, Refund and Credit notes
The payment covers the entire service and the service must be paid before departure.
No refund possible in the event of a reduction in duration due to the fault of the customer. In the event of cancellation beyond the control of the organiser, a credit note valid for 3 months will be offered.
8. Weather and change
The organizer may modify or postpone for inclement weather. No refunds for modifications decided for security reasons.
9. Image Rights and video recording
For safety reasons, the entire outing will be filmed, including the interior and exterior of the vehicle. The customer accepts this recording without the possibility of refusal. The customer may, however, refuse the commercial use of the images in writing. The organizer also reserves the right to take photos and videos for promotional purposes.
10. Applicable Law and Jurisdiction
This contract is subject to Moroccan law. In the event of a dispute, only the courts of Marrakech have jurisdiction.
